Spouse and Children

Family reunion is one of the top priorities of Canadian Immigration. You can sponsor your spouse/common Law partner/Conjugal partner or child.

To be eligible as sponsor you must be:

  1. At least 18 years old
  1. A Canadian citizen, a permanent resident of Canada
    1. If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
    2. You can’t sponsor someone if you’re a permanent resident living outside Canada.
  2. You’re able to prove that you’re not receiving social assistance for reasons other than a disability.
  3. you can provide for the basic needs of any persons you want to sponsor.

Important definitions:

Spouse:

  • A person legally married to you.
    • Must be at least 18 years old.

Common Law Partner:

  • Has been living with you for at least for 12 continuous months.
    • Must be at least 18 years old.
    • Legal marriage is not required.
    • Can be either sex.

Conjugal Partner:

  • Is not married to you or in common law relationship with you.
    • Must be at least 18 years old.
    • Legal marriage is not required.
    • Can be either sex.
    • Lives outside Canada
    • Cannot live with you in their country of residence or marry you because of significant legal and immigration reasons such as sexual orientation, persecution.

Dependent children:

  • Must be under 22 years old.
    • Don’t have a common law partner or spouse.

Note: Child who are 22 or older and are dependent on parents financially due to physical or mental health can also qualify as dependent child

You may not be eligible to sponsor your spouse, partner if you:

  • were sponsored by a spouse or partner and you became a permanent resident less than 5 years ago.
  • are still financially responsible for a previous spouse or partner that you sponsored. This means you’re still bound by the 3-year undertaking to take care of this person.
